Updates on RP-5217 form

 

Over the past several weeks our colleagues have been noticing an increase in discrepancies when submitting the RP-5217 form.  Below are some helpful tips to make the process go a little smoother:

  • The Office of Real Property Tax Payer Services (OORPTPS) understands the reality of real estate closings and knows that on occasion the form will need to be amended “at the closing table”.  They have instructed County Clerks to accept “limited hand-written changes” to the printed PDF.  Acceptable changes include number values such as dates and/or dollar amount.  Other hand-written changes (such as names and addresses) are NOT acceptable.
  • County Clerks will establish their own policies on acceptable changes, and this policy may be revised over time so it is advisable to check frequently with the County web site. Every County may have different submission protocols.
  • It is also important to note that the RP must be the correct size (which is 8 ½ x 14).  If the form is not the proper size it will get rejected.

Rensselaer County Clerk RP-5217 Update

Though the Rensselaer County Clerk’s Office started accepting the new online RP-5217 as of January 1, 2014, the Clerk’s Office was still allowing the triplicate RP-5217 to be used.

However, effective immediately the Rensselaer County Clerk’s Office is

no longer accepting the old triplicate RP-5217.

Also, it is important to note that the form
must be fully typed and that nothing can be written except on the bottom portion.

RP-5217 – PDF format mandatory in Schenectady County in Jan. 2014

As of 1/2/2014 The Schenectady County Clerk’s Office will ONLY accept the online RP-5217.   Please visit the link below to complete and print the RP-5217.  This bar-coded form is NOT intended for the use as a handwritten or typewriter-entry document and WILL NOT be accepted with a Deed by the County Clerk.

New 5217 Real Property Tax Filing Form for Wayne County

 

Below is an announcement from the Wayne County Clerk:

Beginning November 1, 2013 the Office of the County Clerk will accept a single page hard copy of the 5217 Real Property Tax Filing. After December 31, 2013 the Triplicate 5217 form will no longer be accepted. Questions please contact (315) 946-7470 or emailmjankowski@co.wayne.ny.us

RP–5217 Announcement from the Orange County Clerk’s Office

As of September 1, 2013 it will be MANDATORY for all RP-5217 forms to be in the PDF VERSION when presented with documents for recording at the Orange County Clerk’s Office.

The PDF form must be completed according to the New York State Office of Real Property Services instructions available at the above website. This form cannot be printed off the computer with the blanks filled in using a typewriter or be hand written. The PDF form must be completed using a computer.  The fee for the RP-5217 form remains the same.

Last week’s SMPR sponsored CLE was the biggest yet! Thank you!

Last week SMPR held its semi-annual Continuing Legal Education (CLE) course for area attorneys at the NYS Nurses Association in Latham.  The seminar had 2 parts – the first one entitled ‘Claims Chronicles’ which was presented by James Thanasules, Esq.  and the second part called ‘Ethical Considerations in Real Estate and Title Insurance’ presented by Tony Vozza, Esq.   Joining Mr. Thanasules were SMPR’s own Robert Sneeringer, Esq. and Nicholas Ihnatoyla, Esq. for a panel discussion regarding claims that they have seen in the Capital Region.  The topics were a big hit and relevant to what we are seeing in this market.  Attorney Kimberly Crocetta said, “I found the CLE well executed, with informative content from knowledgeable presenters. The topics covered were relevant and the updates and highlighted cases useful.”

Thank you to all of the attorneys who came out to the event and a very special thank you to the presenters, James Thanasules, Esq.  and Tony Vozza, Esq.  of First American Title Insurance Company.

Register Now – STAR Tax Exemption Program beginning in 2014

*Important information re: the STAR Program for your clients*

 

New legislation requires all homeowners receiving a Basic STAR exemption to register with the New York State Tax Department in order to receive the exemption in 2014 and subsequent years. SMPR thought it important to share this information so that you can pass along to your clients.  Here is the pertinent information:

  • Homeowners will not have to register in order to receive their 2013 STAR exemptions.
  • Homeowners will not have to re-register every year. Based on the information provided in the registration process, the Tax Department will monitor homeowners’ eligibility in future years.

How to register

You can register for the STAR exemption online. You will need to:

  • provide a STAR code (NYS is mailing codes to all Basic STAR recipients; or you can use the STAR code lookup)
  • provide the names and social security numbers for all owners of the property and spouses
  • confirm that the property is the primary residence of one of its owners (married couples with multiple residences may only claim one STAR exemption)
  • confirm that the combined income of the owners and their spouses who reside at the property does not exceed $500,000
  • confirm that no resident owner received a residency-based tax benefit from another state

  • Registration started on August 19, 2013 and will continue through December 31, 2013.
