New Albany County Return Postage Policy

Attached please find a recent memorandum from the Albany County Clerk notifying us that they will no longer pay the postage for returning recorded documents. In order to serve our customers better, therefore, SMPR has established a Record and Return Service. SMPR will process and return documents following recording with the Albany County Clerk. Under our program, all documents submitted for recording must include a record and return address on the front page. This address will be crossed out and replaced with a record and return to the SMPR return box located at the Albany County Clerk’s Office – Box 8. After the clerk has returned the original document to the SMPR box, we will mail the document to the original, crossed out record and return address. To defray the costs of processing, postage, and supplies, SMPR will collect a $10.00 fee for all transactions closing on or after August 24, 2009. As always, we appreciate your cooperation and continued business and if you have any questions or concerns regarding our Program, please feel free to contact the Albany Office of SMPR. Changes to RP-5217 Filing Fees.

As of June 1, 2009, the filing fee for the RP-5217 will be as follows: 1. Residential and Farm Properties (boxes A,B, and E) will increase from $75.00 to $125.00 2. All other properties will increase from $165.00 to $250.00 This new fee applies to all deeds submitted for recording on or after June 1, 2009 regardless of the closing date.

Changes to Albany County Recording Fees

Effective March 16, 2009, Albany County has elected to increase recording fees as follows: $45 recording fee Plus $5 per page. The $45 fee includes the fee for the cover page. This new rate applies to all recorded documents.

Changes to Dutchess County Recording Fees

We have been advised that various counties outside NYC are increasing their recording fees pursuant to Chapter 288 of the laws of 2008 which amended CPLR Section 8021 Paragraph 4(a).

Changes to Mortgage Recording Tax Rates Affecting Warren County

New median sales price for Dutchess County Property

The median sales price used to calculate the additional transfer tax due for property conveyed in the Town of Red Hook, Dutchess County, has decreased from $330,000 to $324,700 effective July 1, 2008.

New procedure for closings in Saratoga County

Attached please find a recent memorandum from the Saratoga County Clerk notifying us that they will no longer endorse back to title and abstracting companies any checks written to the county in an incorrect amount. In order to serve our customers better, therefore, we are changing how we collect those recording fees for Saratoga County properties.

Proposed filing fee increase for RP5217 and RP5217NYC CANCELLED!

The 2008 NYS Budget Bill WILL NOT contain a proposed amendment to increase the filing fees for the RP-5217 or the RP-5217NYC.

Effective November 1, 2007; Mortgage Recording Tax increase for Dutchess County

Please be advised that effective November 1, 2007 the mortgage tax rate in Dutchess County will increase from the current rate of $1.05 to the new rate of $1.30 for each one hundred dollars of principal indebtedness or obligation and each remaining major fraction thereof secured.

Columbia County local transfer tax goes into effect for deeds recorded on or after December 1, 2007.
